On June 23, 2022, amendments to the Special Import Measures Act (SIMA) and the Canadian International Trade Tribunal Act (CITT Act) came into force. 

SIMA

With respect to the Canadian International Trade Tribunal’s mandate under SIMA, the Act has been amended to:

• provide that assessments of injury are to take into account impacts on workers employed in the domestic industry and that assessments of retardation are to take into account impacts on jobs;
• require the Tribunal to make inquiry with respect to massive importations when it is acting under section 42 of SIMA;
• modify the criteria for imposing retroactive duties in cases of massive importations; and
• require the Tribunal to initiate expiry reviews of orders and findings.

In accordance with the transitional provisions in the amending legislation, these amendments will not apply to:

• any preliminary or final injury inquiry in respect of a written complaint received by the Canada Border Services Agency prior to June 23, 2022;
• any interim review in respect of a request received by the Tribunal, or initiated by the Tribunal on its own initiative, prior to that date;
• any expiry review where a notice of expiry has been published prior to that date.

It is expected that the amendments will apply for expiry reviews starting with Line Pipe II (finding issued January 4, 2018, in inquiry NQ-2017-002). 

CITT Act

The CITT Act has been amended to provide that trade unions may, with the support of domestic producers, file global safeguard complaints and requests for orders extending safeguard measures.

Resulting changes to the Tribunal’s practices and procedures

As a result of these amendments, the Tribunal will be updating the following:

• Anti-Dumping Injury Inquiries Guide
• Preliminary and Final Injury Inquiry Guidelines
• Expiry Review Guidelines
• Safeguard Inquiry Guidelines
• Various questionnaires, notices and forms
