A Canadian producer or an association of Canadian producers begins the process of seeking relief from alleged injurious dumping or subsidizing by making a complaint to the Canada Border Services Agency. If the Agency initiates a dumping or subsidizing investigation, we initiate a preliminary injury inquiry under the Special Import Measures Act.
In a preliminary injury inquiry, we determine whether the evidence discloses a reasonable indication that the dumping or subsidizing has caused injury or retardation, or is threatening to cause injury.
If there’s no reasonable indication that the dumping or subsidizing has caused injury or retardation, or is threatening to cause injury, we terminate the inquiry, and the Agency terminates the dumping or subsidizing investigation. We issue reasons for our decision no later than 15 days after our determination.
